| We're a day away, and it's time to see who knows what will happen. First, we have the straight poll. We're not offering a prize as we did for the 2008 presidential election margin, but you still get bragging rights, which, on some days, is what it takes! The next issue is what happens on Wednesday. Remember Roland Burris? Remember Al Franken? If Scott Brown wins, it's not a done deal that Paul Kirk ceases to have the ability to vote. The vote still needs to be certified, and the actual certificate issued. Of course, the Republicans will try to make sure Senator Kirk can't vote after the election is over using a 2009 amendment to this law. The amendment reads: (f) Upon failure to choose a senator in congress or upon a vacancy in that office, the governor shall make a temporary appointment to fill the vacancy; provided, however, that the person so appointed shall serve until the election and qualification of the person duly elected to fill the vacancy pursuant to subsection (a) or (c).
Their issue will be that Brown is "qualified" under the Massachusetts Constitution to serve. The Democrats will argue that "qualification" relates to "certification." And on the issue of the outcome of the health reform bill, there are always the options of the House voting in the Senate bill in sum toto, or going straight to reconciliation.
